Agencia Aduanal Esquer Luken, S.C. (hereinafter referred to as the “Agency”), with registered address at Calz. Abelardo L. Rodríguez 101, Col. Aduana Garita 2, Mexicali, Baja California, C.P. 21229, is responsible for collecting your personal data, the use given to such data, and its protection, in compliance with the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties (hereinafter referred to as the “Law”).
Pursuant to Article 3, Section V, of the Law, Personal Data is understood as any information concerning an identified or identifiable natural person.
The purpose of this Privacy Notice is to protect your personal data through lawful, controlled, and informed processing, in order to guarantee your privacy and your right to informational self-determination.
The Agency’s function is to carry out foreign trade operations and, for this purpose, it provides specialized services consisting of warehousing and inspection of goods, inventory control, tariff classification, procedures before government agencies, and the execution of import and export operations under the regimes contemplated in the Customs Law until the completion of customs clearance. For this purpose, the Agency offers timely advisory services in customs and foreign trade matters.
In order to provide such services, it is necessary to collect personal data either when you provide it directly in printed or digital form, through physical or electronic messaging, or from other sources permitted by the Law.
The data collected from you includes:
Copy of registration with the Mexican Tax Authority (SAT).
Copy of the Tax Identification Certificate (RFC).
Copy of the Company’s Articles of Incorporation registered with the Public Registry.
Power of Attorney of the Company’s Legal Representative.
Official identification of the Legal Representative.
Copy of the IMMEX Program and its extensions (if applicable).
Foreign Trade Decree issued by the Ministry of Economy (if applicable).
Proof of address.
Letter of Authorization (Carta Encomienda).
VUCEM Digital Seals.
Registration with the Single Window (Ventanilla Única).
Delegation of Authority Request (Encargo Conferido).
Acceptance of Delegation of Authority (Encargo Conferido).
Your personal data will be used for the following purposes:
To provide the services you have entrusted and/or requested from our Company.
To send information related to your foreign trade operations.
To collect and safeguard the information required by the Customs Broker in accordance with the provisions of Customs Legislation.
To manage procedures before government agencies.
You may exercise your rights of access, rectification, cancellation, or opposition, as well as revoke your consent for the processing of your data (ARCO rights), by submitting a request via email to: teresa.barragan@esquerluken.com, or by sending a written request to the Agency’s address stated at the beginning of this Privacy Notice.
The period for processing your personal data shall be indefinite from the date you provide it, and you may object to the processing of such data at any time you deem appropriate.
Based on Articles 36 and 37 of the Law, personal data may be lawfully transferred for the purposes established in this Privacy Notice to our affiliated companies, subsidiaries, and related parties within the national territory belonging to the same corporate group of the data controller, provided they operate under the same internal processes and policies.
As the party responsible for the processing of your personal data, the Agency is obligated to comply with the principles of lawfulness, consent, information, quality, purpose, loyalty, proportionality, and accountability protected by the Law. Therefore, the protection of personal data is guaranteed and safeguarded through administrative, technical, and physical security measures to prevent loss, alteration, destruction, unauthorized use, access, or disclosure.
